FEDERAL LEGISLATIVE MATERIALS EXERCISE #1

 

Using either LEXIS or WESTLAW, and equivalent printed materials, answer the following:

 

1.     Find the text of the Americans with Disabilities Act.  Find the legislative history of the Act. 

 

 

 

2.     Does Maryland have a statute that provides the same or equivalent protections? Does any other state? If so, list the statutes.

 

 

 

3.     Find cases similar to the one you are researching (i.e. cases dealing with equal access to day care facilities)

  

 

4.     How has the word “disability” been interpreted? Does the statute give guidance? How can you fit the disability mentioned here (ADHD) into the statute?

 

 

    5.    How has the word “accommodation” been interpreted? What constitutes accommodation? What kind of accommodation might be necessary for children similarly situated to the child in the story?

 

    6.  Are there other issues that come to mind that need further exploration? What are they? How would you structure a search to find answers?
