Issues and topics concerning prisoners

  • Wrongful incarceration (an innocent person is incarcerated or put to death through procedural and/or non-reviewable error). This topic is closely tied to the question of judicial review, the intepretation of law, the imposition of the letter rather than the spirit of the law. • Incareceration because of political views, lifestyle, or identity; when (if ever) are political activities or life choices a legitimate threat to the state, thus appropriately controlled through incarceration? Examples: Kiss of the Spider Woman; The Man in the Iron Mask

  • Involuntary incarceration

By shipwreck: Novels and films:  Robinson Crusoe; The Lord of the Flies
Because of determination of incapacity:  Films: Frances; One Flew Over the Cuckoo's Nest. See also Richard Gosden, Coercive Psychiatry, Human Rights and Public Participation and Shrinking the Freedom of Thought, Elizabeth Handsley, Do Hard Laws Make Bad Cases?, Lawrence Stevens, Is Involuntary Commitment for "Mental Illness" a Violation of Substantive Due Process?

  • Violation of human rights: Incarceration before trial; denial of bail; failure to inform the prisoner of his/her rights; failure to inform the prisoner of the charges against him/her); torture in order obtain a confession; incarceration in order to obtain obedience or conformity.
